WWICS ordered to refund Rs 7 lakh to Ludhiana complainant
MOHALI: District Consumer Forum, Mohali, ordered an immigration company — WWICS (World Wide Immigration Consultancy Services) — to refund rupees seven lakh and pay Rs50,000 for the harassment faced by Harpreet Singh Malhotra, a Ludhiana resident.
The complainant Harpreet Singh Malhotra had approached the WWICS in 2011 for a work visa to Canada. Arvinder Singh, an executive of WWICS, apprised him regarding the permanent residence programme in the state of Manitoba (Canada). He further asked the complainant to submit his resume.
Harpreet was informed that WWICS would arrange two sponsors for the complainant and his family. Three different agreements were signed between the Harpreet and WWICS on March 31, 2011. As per the agreements, Harpreet had paid Rs70,000 as retainership fee, plus $4,500 and $6,000 to WWICS. Singh later received an e-mail from the Manitoba Provincial Nominee Programme (MPNP) that his application had been received and would be reviewed to ensure it is complete and eligible for assessment.
The complainant continued his correspondence with the WWICS regarding the status of his case. He was informed by an immigration executive of the company that Gurmit Singh Gill and his wife Baljit Kaur Gill of Canada would be the sponsors for him and his family.
He then asked about the name, place, and contact of the sponsors, but no suitable reply was given to him by WWICS. He finally received a letter dated October 9, 2014, from MPNP that his application was rejected, as it did not meet the requirements of the programme.
The complainant again approached the personnel of WWICS, who assured him that they would further arrange suitable sponsors so that his application is approved within 60 days.
The immigration company was not refunding the amount paid by Harpreet, and also not returning his original experience certificate. He then sent a legal notice to WWICS, but in spite of that, the company did not refund him the amount.
It is learnt that the immigration company, during the course of arguments, had offered to refund a part of the amount paid to them i.e Rs35,000 and $7,800, but this offer was not acceptable to Harpreet, following which the matter was decided on merit, on the basis of records and pleadings.
After hearing all the arguments, the court directed WWICS to refund rupees seven lakh with 12 per cent interest annually for four years since 2011, and a compensation of Rs50,000 for mental agony, harassment, and costs of litigation.
